Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the sygn mobile application ("App") operated by SHCH Studio Ltd ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Use of the App

sygn is a personal journaling application for capturing moments, practicing gratitude, writing intentions, and listening to affirmations. You must be at least 13 years old to use the App. You are responsible for maintaining the confidentiality of your account credentials.

2. Accounts & Data

You may use the App without an account. If you create an account (via Google or Apple Sign-In), your journal data is synced to our servers to enable cross-device access. You retain full ownership of all content you create in the App.

3. Your Content

You retain all ownership rights to the content you create in the App, including moments, gratitude entries, intention pages, and photos ("Your Content"). By using the App, you grant us a limited, non-exclusive, royalty-free licence to store, process, sync, and display Your Content solely for the purpose of providing and improving the App's functionality. This licence ends when you delete Your Content or your account.

Where you use AI-powered features, you grant us permission to send relevant portions of Your Content (such as intention text) to third-party service providers for processing. This data is not stored by these providers after processing.

4. Subscriptions & Payments

sygn offers optional auto-renewing subscriptions ("sygn Premium") that unlock additional features, including unlimited daily goals and gratitude entries, photo attachments, voice-to-text, the full Personal Guide, all affirmation packs, and an unlimited universe. Subscriptions are offered on a monthly or annual basis. Exact prices are displayed in the App before purchase and may vary by region.

Subscriptions are billed through Apple's App Store and are subject to Apple's Standard EULA and the following terms:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription will automatically renew for the same period at the same price unless cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage subscriptions and turn off auto-renewal at any time in your Apple ID account settings after purchase. Cancellations take effect at the end of the current paid period.
• Any unused portion of a free trial, where offered, is forfeited when you purchase a subscription.
• Refunds are handled by Apple in accordance with Apple's refund policy. We are unable to process refunds directly.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with the App's infrastructure or other users' access.
• Upload harmful, offensive, or infringing content.

6. Intellectual Property

The App, including its design, code, affirmation content, audio, and visual assets, is owned by SHCH Studio Ltd and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written consent.

7. AI Features

sygn uses AI to power goal chat, theme clustering, gratitude suggestions, and voice transcription. AI processing is performed through third-party providers listed in our Privacy Policy. Your journal content is not used to train AI models.

AI-generated insights are for informational and reflective purposes only. They are not a substitute for professional medical, psychological, financial, or legal advice. We do not guarantee the accuracy, completeness, or suitability of AI outputs, and AI features do not make automated decisions on your behalf.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, SHCH Studio Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

10. Indemnification

You agree to indemnify and hold harmless SHCH Studio Ltd from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your violation of these Terms or your misuse of the App.

11. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time.

Upon account deletion, we will remove your data from our servers within 30 days. You may export your data before deleting your account via Profile → Export Data. Local data on your device is only removed when you delete the App.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, or pandemics.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of changes by updating the "Last updated" date above. Continued use of the App after changes constitutes acceptance.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union, you retain any mandatory consumer protection rights granted by the laws of your country of residence.

15. General Provisions

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SHCH Studio Ltd regarding the App.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
